3. Account Creation and Security
3.1 Account Creation: To access certain features of the Platform, including Web3 functionalities (e.g., digital wallets, NFTs, or blockchain-based services), you must create an account by providing accurate, complete, and up-to-date information, such as your name, email address, and phone number. You may also need to connect a compatible Web3 wallet (e.g., MetaMask) to interact with blockchain features.

3.3 Security: You are responsible for maintaining confidentiality in connection with your account credentials, including your Web3 wallet private keys, passwords, and recovery phrases. Do not share these with anyone. AURA is not responsible for any loss or damage resulting from unauthorized access due to your failure to secure your credentials.
3.4 Web3 Wallet Responsibility: You acknowledge that AURA does not store or control your Web3 wallet private keys or recovery phrases. contract vulnerabilities, and gas fees.
4.3 Accessibility Features: The Platform includes features like adjustable text sizes, high-contrast modes, and voice navigation to support users with disabilities. You agree to use these features in good faith and report any issues to improve accessibility.
4.4 Prohibited Use: You may not:

● Attempt to reverse-engineer, hack, or disrupt the Platform or its underlying blockchain.
● Upload content that is defamatory, obscene, or infringes on others’ rights, including intellectual property or privacy rights.

5.3 Respectful Conduct: You agree to interact respectfully with other users and refrain from posting or sharing content that is harmful, discriminatory, or offensive, particularly toward people with disabilities or other protected groups.
5.4 Web3 Responsibilities: You acknowledge that blockchain transactions are irreversible. You are responsible for verifying all transaction details (e.g., wallet addresses, token amounts) before confirming. AURA is not liable for losses due to user error or blockchain-related issues.
6. Data Privacy & Protection

7.3 Prohibited Actions: You may not copy, modify, distribute, or create derivative works of AURA’s intellectual property without prior written permission. Unauthorized use may result in termination of your access and legal action.

8. Limitation of Liability
8.1 No Warranties: The Platform is provided “as is” without warranties, express or implied, including as to its availability, accuracy, or fitness for a particular purpose. Web3 functionalities (e.g., blockchain transactions) carry inherent risks, such as smart contract failures or network congestion, which AURA does not guarantee against.
8.2 Liability Cap: To the fullest extent permitted by law, AURA, its affiliates, and their respective officers, employees, or agents will not be liable for any indirect, incidental, special, or consequential damages (e.g., loss of profits, data, or digital assets) arising from your use of the Platform. Our total liability will not exceed $100 or the amount you paid to AURA in the last six months, whichever is greater.
8.3 Web3 Risks: You acknowledge that blockchain technologies involve risks, including loss of funds due to hacking, phishing, or smart contract vulnerabilities. AURA is not liable for such losses unless directly caused by our gross negligence.
8.4 Accessibility Limitations: While we strive to make the Platform accessible, we are not liable for temporary inaccessibility due to technical issues or circumstances beyond our control (e.g., internet outages).
9. Termination and Suspension of Access
9.1 Termination by AURA: We may suspend or terminate your access to the Platform, including your Web3 wallet integration, at our sole discretion, with or without notice, if you:

● Pose a security risk to the Platform.

10. Governing Law and Jurisdiction
10.1 Governing Law: These Terms are governed by and constructed in accordance with the laws of the Kingdom of Cambodia, without regard to its conflict of law principles.
10.2 Jurisdiction: Any disputes arising from these Terms or your use of the Platform will be resolved exclusively in the courts of Phnom Penh, Cambodia, except where arbitration is required by law. You irrevocably consent to the jurisdiction of these courts.
10.3 Arbitration for Web3 Disputes: Disputes related to Web3 functionalities (e.g., NFT ownership, smart contract issues) may be subject to arbitration in Cambodia, as determined by AURA, to the extent permitted by law.

11.1 Updates: AURA reserves the right to modify these Terms at any time. Changes will be posted on the Platform, and we will notify you via email or in-app notifications where feasible. Continued use of the Platform after changes constitutes your acceptance of the updated Terms.
